In force from the day the shop was launched. This is a translation for convenience – in case of any discrepancy, the Polish version prevails.
§1. General information
- The online shop available at wispero.pl (hereinafter: the “Shop”) is run by Karol Płaczek, conducting business under the name Wispero Karol Płaczek, Gawrych Ruda 101, 16-402 Suwałki, Poland, VAT ID PL 845 176 33 65, entered in the Central Register and Information on Economic Activity (hereinafter: the “Seller”).

- These Terms set out the rules for placing orders, concluding sales contracts, delivery, payment, withdrawal from the contract and complaints.
- Prices in the Shop are given in Polish zloty (PLN) and include VAT. The price does not include delivery costs, which are shown during checkout, before the order is placed.
- To use the Shop you need a device with internet access, an up-to-date web browser and an active e-mail address.
§2. Definitions
- Customer – a natural person, legal person or organisational unit placing an order in the Shop.
- Consumer – a Customer who is a natural person concluding a contract not directly related to their business or professional activity.
- Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for them (in particular based on the business activity entered in the CEIDG register). Such a person has the rights of a Consumer with regard to withdrawal from the contract, non-conformity of goods with the contract and prohibited contractual clauses.
- Personalised product – a product made to the Customer’s specification or to meet their individual needs (e.g. with names, a date, graphics, or in dimensions or a colour specified by the Customer).
§3. Placing orders and concluding the contract
- Orders can be placed 24 hours a day using the order form in the Shop. Creating an account is not required.
- To place an order, the Customer adds products to the cart, provides delivery and contact details, selects the delivery and payment method, accepts the Terms and clicks the “Order and pay” button (or an equivalent button indicating the obligation to pay).
- After placing an order, the Customer receives an e-mail confirming its acceptance. The sales contract is concluded upon receipt of this message.
- For Personalised products, the Seller may contact the Customer to agree the content, design or production details. Production starts once the Customer has approved the design.
- The Customer receives the content of the concluded contract (the Terms and the order confirmation) on a durable medium – by e-mail.
§4. Payments
- The available payment methods are shown during checkout. Electronic payments (including instant transfer, BLIK and payment card) are handled by Krajowy Integrator Płatności S.A., based in Poznań (Tpay service).
- Payment is due within 7 days of placing the order. If this deadline passes without payment, the Seller may cancel the order and will inform the Customer.
- At the Customer’s request, the Seller issues a VAT invoice. Invoice details (including the tax ID) should be entered in the order form.
§5. Delivery and lead time
- The Seller delivers within Poland. Available delivery methods: parcel locker, courier and personal pick-up in Suwałki (the Seller agrees the place and time of pick-up with the Customer). The delivery cost is shown before the order is placed.
- Products are made to order. The lead time is given in the product description and counted in working days from receipt of payment (and for Personalised products – from approval of the design). Unless stated otherwise in the description, the lead time is up to 10 working days.
- The carrier’s delivery time, usually 1–2 working days, should be added to the lead time.
- Due to their size or weight, some products cannot be sent to a parcel locker – in that case this option is not available or the Seller will agree another delivery method with the Customer.
- The Customer is advised to inspect the parcel in the presence of the courier and, if it is damaged, to have a damage report drawn up. This does not affect the Consumer’s statutory rights.
§6. Characteristics of wooden products
- Products are made of natural wood and wood-based materials (e.g. plywood, MDF, solid wood). Natural differences in grain, shade and pattern of the wood, as well as marks typical of laser cutting (darkened edges), are features of these materials and are described before purchase.
- Colours in the photos may differ slightly from reality depending on your screen settings.
§7. Right of withdrawal
- A Consumer and an Entrepreneur with consumer rights may withdraw from the contract within 14 days without giving a reason. The period starts on the day the goods come into their possession.
- To withdraw from the contract, it is enough to send an unequivocal statement before the deadline, e.g. by e-mail to sklep@wispero.pl. You may use the model form available on the page Returns & complaints, but this is not obligatory.
- The goods must be returned without delay, no later than 14 days from the date of withdrawal, to: Wispero Karol Płaczek, Gawrych Ruda 101, 16-402 Suwałki, Poland. The direct cost of returning the goods is borne by the Customer.
- The Seller refunds all payments received, including the cost of delivery to the Customer (up to the cheapest standard delivery method offered in the Shop), within 14 days of receiving the withdrawal statement, using the same payment method used by the Customer, unless the Customer agrees to another method at no cost. The Seller may withhold the refund until the goods or proof of their return have been received.
- The Customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
- The right of withdrawal does not apply to Personalised products, i.e. non-prefabricated goods made to the Customer’s specification or to meet their individual needs (Art. 38(1)(3) of the Polish Consumer Rights Act). Information about personalisation is given in the product description.
§8. Complaints – non-conformity of goods with the contract
- The Seller is liable to the Consumer and the Entrepreneur with consumer rights for any non-conformity of the goods with the contract existing at the time of delivery and becoming apparent within 2 years of that time, on the terms set out in the Polish Consumer Rights Act.
- Complaints can be submitted by e-mail to sklep@wispero.pl or in writing to the Seller’s address. Please include: contact details, order number, a description of the non-conformity, photos and your request (repair, replacement, price reduction or withdrawal from the contract).
- The Seller responds to a complaint within 14 days of receiving it.
- In the first instance, the Customer may request repair or replacement of the goods. A price reduction or withdrawal from the contract (where the non-conformity is not insignificant) may be requested, among others, if the Seller has refused or failed to repair or replace the goods, the non-conformity persists or is so significant that it justifies this without prior repair or replacement.
- Towards Customers who are neither Consumers nor Entrepreneurs with consumer rights, the Seller’s liability under the statutory warranty is excluded to the extent permitted by law.
§9. Out-of-court dispute resolution
- A Consumer may use out-of-court complaint and redress procedures, e.g. contact a municipal or district consumer ombudsman, ask the Provincial Inspector of Trade Inspection in Białystok to initiate mediation, or apply to a permanent consumer arbitration court.
- Information about these procedures is available at prawakonsumenta.uokik.gov.pl. Using them is voluntary.
§10. Décor hire
Products marked in the Shop as available for hire (e.g. event décor by the day) are not sold through the cart. The Seller agrees the hire terms, date, deposit and transport with the Customer individually. These Terms apply to hire only to the extent that the parties have not agreed otherwise.
§11. Personal data
The controller of Customers’ personal data is the Seller. Details can be found in the Privacy policy.
§12. Final provisions
- The Terms are available free of charge on the Shop’s website in a form that allows them to be downloaded and printed.
- The Seller may amend the Terms for important reasons (e.g. changes in legislation). Orders placed before the change are governed by the Terms in force on the date the order was placed.
- Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. The provisions of these Terms do not limit Consumers’ rights under mandatory provisions of law.
